Subsequently on April 3, 2003, Purdue sued Teva USA on its 10, 20 and 40 mg tablet products. On January 5, 2004, those three patents were held unenforceable in a related case, Purdue Pharma L.P. v. Endo Pharmaceuticals Inc., pending before the same judge as in Teva USA's case. On June 7, 2005, the U.S. Court of Appeals for the Federal Circuit affirmed the January 5th decision. Purdue has moved for rehearing and en banc review. On June 25, 2004, Teva USA's motion for summary judgment was granted on the ground that collateral estoppel applied to the inequitable conduct finding in the Endo case. On March 31, 2004, Teva USA commenced sales of its 80 mg tablets based upon the court's decision in the Endo case. The 2003 annual sales of the branded product in the U.S. were estimated to be approximately 7 million. Were Pharmacia ultimately to be successful on its allegation of patent infringement, Sicor could be required to pay damages and be enjoined from selling that product. Simultaneous administration of BIAXIN tablets and didanosine to 12 HIV-infected adult patients resulted in no statistically significant change in didanosine pharmacokinetics. Concomitant administration of fluconazole 200 mg daily and clarithromycin 500 mg twice daily to 21 healthy volunteers led to increases in the mean steady-state clarithromycin Ck and AUC of 33% and 18%, respectively. Steady-state concentrations of 14-OH clarithromycin were not significantly affected by concomitant administration of fluconazole. Concomitant administration of clarithromycin and ritonavir n 22 ; resulted in a 77% increase in clarithromycin AUC and a 100% decrease in the AUC of 14-OH clarithromycin. Clarithromycin may be administered without dosage adjustment to patients with normal renal function taking ritonavir. However, for patients with renal impairment, the following dosage adjustments should be considered. For patients with CLcn 30 to 60 mUmin, the dose of clarithromycin should be reduced by 50%. For patients with CLcn 30 ml min, the dose of clarithromycin should be decreasedby 75%. Spontaneous reports in the post-marketing period suggest that concomitant administration of clarithromycin and oral anticoagulants may potentiate the effects of the oral anticoagulants. Prothrombin times should be carefully monitored while patients are receiving clarithromycin and oral anticoagulants simultaneously. Elevated digoxin serum concentrations in patients receiving clarithromycin and digoxin concomitantly have also been reported in post-marketing surveillance. Some patients have shown clinical signs consistent with digoxin toxicity, including potentially fatal arrhythmias. Serum digoxin concentrations should be carefully monitored while patients are receiving digoxin and clarithromycin simultaneously. The loss of patent protection for two key antibiotics zithromax and biaxin in 2005 has opened the opportunity for increased share of voice for new antibiotics that can replace the macrolides as first line therapies to treat RTI's. So in addition to resistance growth, there's an opportunity with regard to marketing with regards to the fact that zithromax and biaxin have both gone off patent. Furthermore, due to macrolide resistance concerns physicians are overusing broad spectrum fluoroquinolones antibiotics in the place of macrolides. Fluoroquinolones are not selective and have worsened side affects and cross resistance within the fluoroquinolones class. Physicians would prefer to reserve fluoroquinolones for second line treatment for these reasons. In fact there is a need for new classes of antibiotics that preserve the mild safety profile and selectivity that the macrolides maintain, but that can overcome emerging resistance and ketolides clearly answer the call.
